# Terms of Service

## Welcome to Dongu

First of all, thank you for using the Dongu service (hereinafter referred to as "Dongu"). These Terms and Conditions describe the relationship between Daldal Town Corporation (hereinafter referred to as "Daldal Town"), which provides the service, and Daldal Town members (hereinafter referred to as "Members") or non-members who use the service, and contain useful information that may help you use the service.

### Article 1 (Purpose) The purpose of these terms and conditions is to stipulate the rights, obligations, and responsibilities of the company and users in using the Dongu service (hereinafter referred to as the "Service") operated by Daldal Town.

### Article 2 (Definition)

① "Dongu" is the name of the online matching platform operated by Daldal Town and refers to the Service and its operator.

② "User" refers to members and non-members who access "Dongu" and receive the services provided by the "Dongu" in accordance with these Terms and Conditions.

③ "Member" refers to a person who has registered as a member of "Dongu" and can continue to use the services provided by the "Dongu".

④ 'Non-member' refers to a person who uses the services provided by "Dongu" without registering as a member.

### Article 3 (Clarification, Explanation, and Amendment of Terms and Conditions)

① "Dongu" shall post the contents of these Terms and Conditions, the name of the company and representative, the address of the business location (including the address of the place where consumer complaints can be handled), telephone number, e-mail address, business registration number, e-commerce business notification number, and personal information manager within the "Dongu" service so that users can easily recognize them. However, the contents of the Terms and Conditions may be made available to users through the connection screen.

② Before the user agrees to the Terms and Conditions, the "Dongu" shall seek the user's confirmation by providing a separate connection screen or pop-up screen so that the user can understand the contents stipulated in the Terms and Conditions.

③ "Dongu" may amend these Terms and Conditions to the extent that it does not violate the relevant laws such as the Act on Consumer Protection in Electronic Commerce, etc., the Act on Regulation of Terms and Conditions, the Basic Act on Electronic Documents and Electronic Transactions, the Electronic Financial Transactions Act, the Electronic Signature Act, the Act on Promotion of Information and Communication Network Utilization and Information Protection, the Act on Door-to-Door Sales, and the Consumer Electronics Act.

④ If "Dongu" revises the Terms and Conditions, it shall specify the effective date and the reason for the revision and notify it on the initial screen of the mall along with the current Terms and Conditions from 7 days before the effective date to the day before the effective date. However, if the contents of the terms and conditions are changed to the disadvantage of the user, it shall be notified with a prior grace period of at least 30 days. In this case, "Dongu" shall clearly compare the contents before the revision and the contents after the revision and display them so that users can easily understand them.

⑤ If "Dongu" revises the Terms and Conditions, the revised Terms and Conditions shall apply not only to contracts concluded after the effective date, but also to contracts already concluded before that date, unless there is no objection within the notice period, the revised Terms and Conditions shall be deemed to have been agreed upon, and the service can be continued to be used.

⑥ For matters not specified in these Terms and Conditions and the interpretation of these Terms and Conditions, the Act on Consumer Protection in Electronic Commerce, Regulation of Terms and Conditions, etc. 

### Article 4 (Provision and Modification of Services)

As a service "Dongu" will provide the following: 

1. The ability to create and plan events which are activities to be participated in with other users. 
2. A service to evaluate and share reviews of the events attended. 
3. Services to provide feedback about other attendees which will be reflected in Manner Points.
4. Other services that "Dongu" defines.

As a platform service that connects users to each other, "Dongu" endeavors to prevent incidents between users and/or at events, but "Dongu" shall not be liable for damages caused by incidents and accidents arising from activities between users unless there is intentional or negligent behavior by "Dongu". 

### Article 5 (Suspension of Service)

① "Dongu" may temporarily suspend the provision of the service in the event of maintenance, inspection, replacement, and/or the breakdown of information and communication facilities such as computers, or interruption of communication.

"Dongu" may modify, change, or terminate all or part of the Service if there is a substantial need for the operation or improvement of the Service. In the event of modification, change, or termination of all or part of the services provided free of charge, no separate compensation shall be provided unless special provisions are made in relevant laws and regulations.

③ If the service cannot be provided for reasons such as switching business items, abandonment of business, or integration between companies, Dongu shall notify the user in the manner specified in Article 8 and compensate the consumer according to the conditions originally proposed by Dongu. However, if "Dongu" does not notify the compensation standard, the user's mileage or accumulated points shall be paid to the user in kind or cash equivalent to the value of the currency used in "Dongu".

### Article 6 (Membership)

(1) The user shall apply for membership by filling in the membership information according to the membership form prescribed by "Dongu" and expressing his/her agreement to these Terms and Conditions.

"Dongu" shall register the user who applies for membership as described in Paragraph 1 as a member, and may cancel the membership or suspend the use if any of the following items apply.

1. If the subscriber has been canceled or disciplined for reasons such as violation of the operating principles or laws of "Dongu" in the past. However, exceptions are made for those who have obtained the approval of "Dongu" to rejoin the membership after 3 years.
2. If there are any falsehoods, omissions, or errors in the registration contents.
3. The same person attempts to create multiple accounts.
4. Attempting to create an account using another person's name or information.
5. If the mobile phone number is confirmed to have a history of transaction fraud on a fraud information collection site or government agency site, etc.
6. If it is judged that registering as a member is significantly hindered by the technology of "Dongu".

If there is a change in the information registered at the time of membership registration, the member shall notify "Dongu" of the change within a reasonable period of time by modifying the membership information.

### Article 7 (Withdrawal of Membership and Disqualification)

Members may request withdrawal at any time from "Dongu" and "Dongu" shall immediately process the withdrawal. However, in the case of users who have engaged in unauthorized use or disputes, the termination of the service use contract and withdrawal may be restricted for a certain period of time.

If a member falls under any of the following reasons, "Dongu" may limit, suspend, or withdraw membership.

1. If the member registers false information when applying for membership.
2. If the same person creates multiple accounts.
3. Creating an account using another person's name or information.
4. Failure to pay the price of goods purchased using "Dongu" or other debts incurred by the member in connection with the use of "Dongu" on the due date.
5. Threatens the order of e-commerce, such as interfering with the use of "Dongu" for others or stealing their information.
6. Using "Dongu" for commercial or promotional purposes.
7. Using "Dongu" to perform acts prohibited by laws and regulations or the Terms and Conditions or contrary to public order and morals.

③ After "Dongu" restricts or suspends membership, if the same act is repeated more than twice or the reason is not corrected within 30 days, "Dongu" may revoke membership.

④ If "Dongu" revokes membership, the membership registration shall be canceled. In this case, the member will be notified and given a period of at least 30 days to show cause before the membership registration is canceled.

⑤ Upon termination of the use contract, user information will be deleted and cannot be recovered, except in cases where user information is retained in accordance with laws and regulations and the Privacy Policy.

### Article 8 (Notification to Members)

(1) When "Dongu" sends a notice to a member, it may be sent to the phone number or e-mail address specified by the member in advance by agreement with "Dongu".

In the case of notification to an unspecified number of members, "Dongu" may substitute individual notifications by posting it on the "Dongu" bulletin board for more than one week.

### Article 9 (Purchase Application and Consent to Provide Personal Information)

Users of "Dongu" shall apply for purchase by the following or similar methods on "Dongu", and "Dongu" shall provide each of the following contents in an easy-to-understand manner when the user applies for purchase.

1. Search and selection of goods, etc.
2. Input of the recipient's name, address, telephone number, e-mail address (or mobile phone number), etc.
3. Confirmation of the contents of the Terms and Conditions, the services for which the right of withdrawal of subscription is limited, and the contents related to the cost burden such as shipping fee and installation fee, etc. 
4. Indicating that you agree to these Terms and Conditions and confirm or deny the items in item 3 above
(e.g., mouse click).
5. Application for purchase of goods, etc., and confirmation thereof or agreement to confirmation by "Dongu".
6. Selection of payment method. 

If "Dongu" needs to provide the buyer's personal information to a third party, it must notify the buyer of 1) the person to whom the personal information is provided, 2) the purpose of using the personal information of the person to whom the personal information is provided, 3) the items of personal information to be provided, and 4) the period of retention and use of personal information by the person to whom the personal information is provided and obtain consent. (The same applies to changes in consent.)

③ If "Dongu" entrusts a third party to handle the personal information of the buyer, it must notify the buyer of 1) the person to whom the personal information is entrusted, 2) the contents of the work to be entrusted with the personal information, and 3) obtain the buyer's consent. (The same applies if the consent is changed.) However, if it is necessary for the fulfillment of the contract for service provision and related to the convenience of the buyer, the notice and consent procedures may be waived by notifying the buyer through the Privacy Policy in the manner prescribed by the Act on Promotion of Information and Communication Network Utilization and Information Protection, etc.

### Article 10 (Establishment of Contract)

① "Dongu" may not approve the purchase application as described in Article 9 if any of the following items apply. However, in the case of concluding a contract with a minor, it shall be notified that the contract may be canceled by the minor or his/her legal guardian if the consent of the legal guardian is not obtained.

1. If there are any falsehoods, omissions, or errors in the application contents.
2. If the minor purchases goods and services prohibited by the Youth Protection Act, such as tobacco, alcohol, etc.
3. If it is determined that accepting the purchase application is significantly hindered by "Dongu" technology.

②The contract shall be deemed to be concluded when the consent of Dongu reaches the user in the form of the receipt confirmation notice in Article 12.1.
③ "Dongu"'s intention to accept shall include information on the confirmation of the user's purchase application, the availability of sales, and the correction or cancellation of the purchase application.

### Article 11 (Payment Method) 

The payment method for goods or services purchased from "Dongu" can be made by any of the following methods. However, "Dongu" may not add any nominal fees to the price of goods or services for the user's payment method.

1. Various account transfers such as phone banking, internet banking, mail banking, etc. 
2. Payment by various cards such as prepaid cards, debit cards, credit cards, etc.
3. Online bank account deposit. 
4. Payment by electronic money. 
5. Payment upon receipt. 
6. Payment by points paid by "Dongu" such as mileage, etc.
7. Payment by gift certificates contracted with "Dongu" or recognized by "Dongu" 
8. Payment by other electronic payment methods, etc.

### Article 12 (Notification of Receipt, Change and Cancellation of Purchase Application)

① "Dongu" shall send a receipt confirmation notice to the user if there is a purchase application from the user.
② If there is a discrepancy in the user's intention, the user may request to change or cancel the purchase application immediately after receiving the receipt of the confirmation notice, and "Dongu" shall process the request without delay if there is a request from the user before delivery. However, if the payment has already been made, the provisions of Article 15 regarding withdrawal of subscription, etc. shall apply.

### Article 13 (Supply of Goods, etc.)

Unless there is a separate agreement with the user regarding the timing of the supply of goods, etc., "Dongu" shall take other necessary measures such as customization, packaging, etc. so that the goods can be delivered within 7 days from the date the user makes a request. However, if "Dongu" has already received all or part of the payment for the goods, it shall take action within 3 business days from the date of receipt of all or part of the payment. At this time, "Dongu" shall take appropriate measures so that the user can check the procedure and progress of the supply of goods, etc. The company shall specify the means of delivery, the person who bears the delivery cost by means, and the delivery period by means of the goods purchased by the user. If the company exceeds the contractual delivery period, the company shall compensate the user for the resulting damages. However, this shall not apply if "Dongu" proves that there is no intention or negligence.

### Article 14 (Refund)

 "Dongu" shall notify the user of the reason “Dongu” cannot deliver or provide the goods applied for purchase for reasons such as “out of stock”, and if the user has made the payment for the goods in advance, the user shall be refunded or “Dongu” will take the necessary measures for refund within 3 business days from the date of receipt of the payment.

### Article 15 (Withdrawal of Subscription, etc.)

① A user who has concluded a contract with “Dongu” for the purchase of goods, etc. may withdraw his/her subscription within 7 days from the date of receipt of a written document regarding the contents of the contract pursuant to Article 13, Paragraph 2 of the Act on Consumer Protection in Electronic Commerce, etc. (if the supply of goods, etc. is later than the date of receipt of the written document, it refers to the date on which the goods, etc. are supplied or the supply of goods, etc. begins). However, if the Act on Consumer Protection in Electronic Commerce, etc. provides otherwise regarding the withdrawal of a subscription, the provisions of the Act shall apply.

② When the user receives the goods, etc., the user cannot return or exchange the goods if the user falls under any of the following subparagraphs.

1. If the goods, etc. are lost or damaged due to reasons responsible to the user (for example, if the packaging is damaged in order to check the contents of the goods, etc.). 
2. If the value of the goods has decreased significantly due to use or partial consumption by the user.
3. If the value of the goods has decreased significantly over time to the extent that resale is difficult.
4. In the case of damage to the packaging of the original goods, etc. If it is possible to duplicate the goods, with the same performance. 

③ In the case of Paragraph 2, Items 2 through 4, the user's right to withdraw the subscription shall not be restricted unless "Dongu" has specified the fact that the withdrawal of the subscription is restricted in advance in a place where the consumer can easily recognize it or has taken measures such as providing a trial product.

④ Notwithstanding the provisions of Paragraphs 1 and 2, if the contents of the goods, etc. are different from the contents of the display or advertisement or are performed differently from the contract, the user may withdraw the subscription within 3 months from the date of supplying the goods, etc. and within 30 days from the date of knowing or being able to know the fact.

### Article 16 (Effect of Withdrawal of Subscription, etc.)

① If "Dongu" receives the goods, etc. from the user, "Dongu" shall refund the price of the goods, etc. already paid within 3 business days. In this case, if "Dongu" delays the refund of the goods to the user, the delayed interest calculated by multiplying the delayed interest rate specified in Article 21.2 of the Enforcement Decree of the Act on Consumer Protection in Electronic Commerce, etc. is paid for the delayed period.

② In refunding the above payment, if the user has paid for goods or services by payment methods such as credit card or electronic money, "Dongu" shall request the business that provided the payment method to suspend or cancel the charge for goods or services without delay.

③ In the case of withdrawal of subscription, the user shall bear the cost of returning the goods supplied. "Dongu" shall not claim penalties or damages from the user for withdrawing the subscription, etc. However, if the contents of the goods are different from the contents of the display or advertisement or the contract is performed differently and the user withdraws the subscription, the cost of returning the goods shall be borne by "Dongu".

④ If the user bears the shipping cost when receiving the goods, etc., "Dongu" shall clearly indicate who bears the cost in case of withdrawal of the subscription so that the user can easily understand.

### Article 17 (Personal Information Protection)

① When collecting personal information of users, "Dongu" collects the minimum amount of personal information to the extent necessary to provide services.

② "Dongu" does not collect information necessary for the fulfillment of the purchase contract in advance when registering for membership; however, this is not the case in the event that identification is required prior to the purchase contract in order to fulfill the obligations under relevant laws and regulations and minimum specific personal information is collected.

③ When collecting and using the user's personal information, "Dongu" shall notify the user of the purpose and obtain the user's consent.

④ "Dongu" shall not use the collected personal information for any purpose other than the purpose, and if a new purpose of use occurs or if it is provided to a third party, the purpose shall be notified to the user at the stage of use and provision and consent shall be obtained. However, exceptions shall be made in cases where the relevant laws and regulations stipulate otherwise.

⑤ If "Dongu" is required to obtain the user's consent under Paragraphs 2 and 3, it must specify or notify in advance the matters stipulated in Article 22, Paragraph 2 of the Act on Promotion of Information and Communications Network Utilization and Information Protection, such as the identity of the person in charge of personal information management (affiliation, name and phone number, and other contact information), the purpose of collecting and using information, and the matters related to the provision of information to third parties (recipient, purpose of provision, and content of information to be provided), and the user may withdraw this consent at any time.

⑥ The user may request to view and correct errors in his/her personal information held by "Dongu" at any time, and "Dongu" shall be obligated to take necessary measures without delay. If the user requests the correction of an error, "Dongu" shall not use the personal information until the error is corrected.

⑦ "Dongu" shall limit the number of persons handling the user's personal information to a minimum in order to protect personal information, and shall bear all responsibility for the user's damages caused by the loss, theft, leakage, provision to a third party without consent, falsification, etc. of the user's personal information, including credit card, bank account, etc.

⑧ "Dongu" or a third party who has received personal information from it shall destroy the personal information without delay when the purpose of collecting or receiving the personal information is fulfilled.

⑨ "Dongu" does not set the consent field for the collection, use, and provision of personal information to be selected in advance, and specifically specifies the services that are restricted when the user refuses to consent to the collection, use, and provision of personal information, and does not restrict or refuse to provide services such as membership registration due to the user's refusal to consent to the collection, use, and provision of personal information that is not a mandatory collection item.

### Article 18 (Location-Based Services) 

① "Dongu" includes Location-Based services for the convenience of users.

② This is a free service provided by receiving location information from a location information provider that collects the location information of the user's terminal device.

③ Specifically, it retrieves information posted in the vicinity based on the user's current location and may provide additional information or advertising information to provide convenience.

④ Users (including legal representatives of users under the age of 14) may withhold their consent to the use of personal location information related to the "Dongu" service, the purpose of providing it, the scope of recipients, and parts of the Location-Based service, or withdraw all or part of their consent to use and provide it, and may request a temporary suspension.

⑤ In accordance with the provisions of the Act on the Protection and Use of Location Information, personal location information and confirmation of the location information use and provision room are stored for more than 6 months, and if the user withdraws all or part of the consent, "Dongu" will destroy the personal location information and confirmation of the location information use and provision room corresponding to the withdrawn part without delay.

⑥ The user (including the legal representative of the user under the age of 14) may request "Dongu" to view or notify the reason and contents of the location information use and provider confirmation data about the user or the user's personal location information when it is provided to a third party in accordance with the law and may request correction if there is an error.

⑦ If "Dongu" directly provides the user's personal location information to a third party designated by the user, "Dongu" will immediately notify the user of the person to whom the personal location information is provided, the date of provision, and the purpose of provision, such as the smartphone that collected the personal location information in accordance with the law.

⑧ "Dongu" designates a person in charge of location information management (CEO Jung Min-soo, privacy@daldaltown.com) to safely protect the user's location information.

⑨ In the event of a dispute between the user and "Dongu" regarding location information, the user may apply for mediation with the Personal Information Dispute Mediation Committee in accordance with the provisions of Article 28, Paragraph 2 of the Act on the Protection and Use of Location Information and Article 43 of the Personal Information Protection Act.

### Article 19 (Limitation of Dongsu's Obligations and Liability)

① "Dongu" shall not engage in any acts prohibited by laws and regulations or contrary to public order and morals, and shall do its best to provide goods and services continuously and stably in accordance with these Terms and Conditions.

② "Dongu" shall have a security system to protect users' personal information (including credit information) so that users can use the internet service safely.

③ "Dongu" shall be responsible for compensating the user for any damages caused by unfair display or advertisement of goods or services in accordance with Article 3 of the Act on Fairness of Display and Advertising.

④ "Dongu" does not send commercial e-mails for commercial purposes that users do not want.

⑤ To the extent permitted by law, “Dongu” does not make any promises or guarantees about any specific matters not specified in these Terms and Conditions in relation to Dongu's services.

### Article 20 (Member's Obligations for ID and Password)

① Members are responsible for managing their IDs and passwords, except in the case of Article 17.

② Member shall not allow any third party to use his/her ID and password.

③ If a member realizes that his/her ID and password have been stolen or are being used by a third party, he/she shall immediately notify “Dongu” and follow the instructions provided by “Dongu”.

### Article 21 (Obligations of Users) 

Users shall not engage in the following acts:

1. Registering false information when applying or changing.
2. Stealing other people's information.
3. Change the information posted on "Dongu".
4. Transmitting or posting information (computer programs, etc.) other than the information prescribed by "Dongu". 
5. Infringement of intellectual property rights such as copyright of "Dongu" or other third parties.
6. Acts that damage the reputation or interfere with the business of "Dongu" or other third parties.
7. Disclosing or posting obscene or violent messages, images, or other information contrary to public order and morals on the app. 

### Article 22 (Attribution of Copyright and Restriction of Use)

① Copyright and other intellectual property rights for works created by "Dongu" shall belong to "Dongu".

② The user shall not reproduce, transmit, publish, distribute, broadcast, or otherwise use for commercial purposes or cause a third party to use for commercial purposes any information obtained through the use of "Dongu" to which intellectual property rights belong to "Dongu" without the prior consent of "Dongu".

③ "Dongu" shall notify the user when using the copyright belonging to the user under the agreement.

### Article 23 (Dispute Resolution)

① "Dongu" shall establish and operate a damage compensation processing organization to reflect legitimate opinions or complaints raised by users and compensate for the damage.

② "Dongu" shall prioritize the handling of complaints and opinions submitted by users. However, if it is difficult to process promptly, the user will be notified of the reason and processing schedule immediately.

③ If a user applies for damage relief in connection with an e-commerce dispute between "Dongu" and the user, it may be subject to mediation by the Fair Trade Commission or a dispute mediation organization commissioned by the city or provincial governor.

### Article 24 (Jurisdiction and Governing Law)

① Lawsuits concerning e-commerce disputes between "Dongu" and users shall be subject to the exclusive jurisdiction of the district court having jurisdiction over the user's address at the time of filing, and if there is no address, the district court having jurisdiction over the residence. However, if the user's address or residence is not clear at the time of filing, or if the user is a foreign resident, the case shall be filed with the competent court under the Civil Procedure Act.

② The laws of the Republic of Korea shall apply to e-commerce lawsuits filed between “Dongu” and the user.

This English version of the "Dongu" Terms of Service is a translation based on the original Korean version of the "Dongu" Terms of Service. If there is any conflict between these two versions, the original Korean version of the "Dongu" Terms of Service shall prevail. The relationship between you and Dongu in relation to the "Dongu" Terms of Service or Dongu Services shall be governed by the laws of Republic of Korea, and any dispute arising between you and Dongu arising out of or in connection with the "Dongu" Terms of Service or Dongu Services, shall be resolved in accordance with the procedures set out in the Civil Procedure Act of Republic of Korea.
