# Location-Based Services Terms of Use
### Article 1 (Purpose)
The purpose of these Terms and Conditions is to regulate the rights, obligations and responsibilities and other necessary matters between the company and the personal location information subject (hereinafter referred to as "User") using the Location-Based service provided by Daldal Town Corporation (hereinafter referred to as "company") for the Location-Based service.
### Article 2 (Effect and Change of Terms of Use)
① These Terms of Use shall take effect when the User agrees to the Terms of Use and is registered as a user of the Location-Based service in accordance with the procedures established by the company.
② When the user clicks the "Agree" button for this agreement, it is deemed that the user has read all the contents of this agreement, fully understood it, and agreed to its application.
③ The company may modify these terms if necessary, such as for the purpose of reflecting changes in Location-Based services, to the extent that it does not violate relevant laws and regulations.
④ If the terms are changed, the company shall notify users through the company's homepage or service announcements (hereinafter referred to as "homepage") at least 15 days before the effective date. However, if the amendment results in a significant change in user rights, the company will notify users individually by sending an email, if there is no email address, others methods to notify will apply, such as sending an electronic message within the app or displaying a notification message within the app or sending a text message to the registered mobile phone number at least 30 days before the effective date.
⑤ If the company makes a notice or notification pursuant to the preceding paragraph and clearly notifies the user that he/she shall be deemed to have approved the revised terms unless he/she expresses his/her refusal by the 7th day after the effective date of the revised terms from the date of the notice or notification, but the user does not express his/her intention, he/she shall be deemed to have approved the revised terms. If you do not agree to the revised terms, you may withdraw your consent to these terms.
### Article 3 (Non-Terms of Use)
Matters not specified in these terms shall be governed by relevant laws and regulations such as the Act on the Protection and Use of Location Information, the Personal Information Protection Act, the Telecommunications Business Act, the Act on the Promotion of Information and Communications Network Utilization and Information Protection, etc. and guidelines set by the company.
### Article 4 (Contents of the Service)
The company provides the following Location-Based services using the user's location information collected from location information providers, etc.
① Providing or recommending information search results and contents utilizing location information.
② Location sharing, location/area-specific notifications, and routes for general convenience.
③ Content tagging for Location-Based content categorization.
④ Location-Based customized advertisements.
### Article 5 (Service Fees)
The Location-Based services provided by the company are free of charge.
However, data communication fees incurred while using wireless services are separate and subject to the policies of each mobile operator to which the user subscribes.
### Article 6 (Modification, Restriction, and Suspension of Services)
① The company may change, restrict, or discontinue all or part of the location-based services if the company is unable to maintain the location-based services due to various circumstances such as policy changes or changes in related laws.
② The company may restrict or suspend the use of the service in any of the following cases.
1. If the user intentionally or grossly interferes with the operation of the company's services.
2. If it is unavoidable due to inspection, repair or construction of facilities for the service.
3. When the telecommunications service is suspended by a telecommunications service provider stipulated in the Telecommunications Business Act.
4. When the use of the service is interfered with due to a national emergency, failure of service facilities, or excessive use of the service.
5. When the company recognizes that it is inappropriate to continue providing the service due to other significant reasons.
③ When the company restricts or suspends the use of the service in accordance with the provisions of Paragraphs 1 and 2, the reason and the period of restriction shall be announced in advance through the company's homepage or notified to the user.
### Article 7 (Use or Provision of Personal Location Information)
① The company shall notify and obtain consent to these Terms and Conditions when providing Location-Based services using personal location information.
② The company shall not provide personal location information to a third party without the consent of the user, and if it is provided to a third party, it shall notify the user in advance of the recipient and the purpose of the provision and obtain the user's consent.
③ When the company provides personal location information to a third party designated by the user, the company shall immediately notify the user of the recipient, date, and purpose of the provision through the communication terminal device that collected the personal location information each time. However, in the following cases, the company shall notify the user through the communication terminal device or e-mail address specified by the user in advance.
1. If the communication terminal device that collected the personal location information does not have the function of receiving texts, voice calls or videos.
2. If the user requests in advance to be notified by a communication device other than the communication device that collected the user's personal location information, or by e-mail address, etc.
④ The company automatically records and preserves confirmation data on the use and provision of personal location information based on Article 16, Paragraph 2 of the Act on the Protection and Use of Location Information, and keeps such data for 6 months.
### Article 8 (Purpose of Retention and Retention Period of Personal Location Information)
The company shall retain personal location information for the purpose of providing Location-Based services as follows.
① When the purpose of using and providing Location-Based services pursuant to Article 4 of this Agreement is achieved, personal location information shall be destroyed without delay.
② However, in the case of services where location information is stored with posts or contents created by users, personal location information is stored for the storage period of the posts or contents.
③ If necessary for the provision of other Location-Based services, personal location information may be retained for the minimum period necessary to fulfill the purpose of use.
④ Notwithstanding Paragraphs 1, 2, and 3 above, if there is a legitimate reason to retain personal location information in accordance with other laws or the Location Information Act, we will comply.
### Article 9 (Rights of the Subject of Personal Location Information)
① Users may withhold all or part of their consent to the use and provision of Location-Based services using personal location information at any time.
② The user may withdraw all or part of the consent to the use and provision of Location-Based services using personal location information at any time. In this case, the company shall destroy the personal location information to the extent of the withdrawal without delay and the confirmation of the location information use and provision room.
③ The user may request a temporary suspension of the use and provision of personal location information. In this case, the company shall not refuse and shall provide technical means to fulfill this request.
④ The user may request the company to view or notify the following data, and if there is an error in the data, the user may request correction. In this case, the company shall not refuse the request without a justifiable reason.
1. Use of location information about the user and confirmation data of the provider company.
2. The reason and contents of the user's personal location information provided to a third party in accordance with the provisions of the Act on the Protection and Use of Location Information or other laws and regulations.
⑤ The user may make a request to the company using the contact information in Article 14 of this Agreement to exercise the rights.
### Article 11 (Indemnification)
① The company shall not be liable for any damages caused to the user if the company is unable to provide Location-Based services in any of the following cases.
1. If there is a natural disaster or equivalent force majeure condition.
2. If there is an intentional service interference by a third party that has entered into a service partnership agreement with the company to provide Location-Based services.
3. If there is an obstacle to the use of Location-Based services due to reasons attributable to the user.
4. In the event of other reasons other than Items 1 through 3 that are not caused by the company's intentional or negligent behavior.
② The company does not guarantee the reliability, accuracy, etc. of the Location-Based service and the information, data, and facts posted on the Location-Based service, and shall not be liable for any damages caused by the user.
### Article 12 (Mediation of Disputes and Others)
① The company shall consult with the user in good faith to resolve disputes related to location information.
② If the dispute is not resolved in the consultation in the preceding paragraph, the company and the user may apply for financial assistance to the Korea Communications Commission under the provisions of Article 28 of the Act on the Protection and Use of Location Information, or apply for mediation to the Personal Information Dispute Mediation Committee under the provisions of Article 43 of the Personal Information Protection Act.
